Who we are
Applicant Action LLC, a Wyoming limited liability company doing business as Applicant Auction ("Applicant Auction", "we" or "us"), runs auctions for the domain industry. This notice explains how we handle personal information on applicantauction.com and in our auctions, including NDA requests, bidder registration, data rooms and the auction platform.
Questions or requests about your information go to info@applicantauction.com.
What we collect
- Contact requests: your name, email address, company and phone number.
- NDA requests and signed NDAs: your name, title, email address, company, country, buyer type, the lots you are interested in, and, if you give them, your phone number, website and how you heard about the auction. We also keep your drawn signature and the signed NDA.
- Bidder registration: identity and ownership information about you, your company and any consortium members; proof of funds and source-of-funds documents; sanctions screening results; bank details for deposits and refunds; and the documents you upload.
- Data room and auction platform: your sign-ins, the documents you view or download and when, your questions, your bids and Maximum Commitment, and your deposit and payment status.
- Update subscriptions: your email address.
- Automatically, when you use the site: your IP address, browser and device type, the pages you visit, the page that referred you and the time of each visit. Some of this comes from cookies and similar technologies (see below).
- From others: people who introduce you to us, public sources, and the screening databases we use to verify bidders.
How we use it
- To answer your enquiries.
- To send, record and enforce NDAs.
- To verify bidders, including identity, ownership, funds and sanctions checks, and to decide who may bid.
- To run the data room and the auction, including deposits, payment of the purchase price, refunds and closing.
- To tell you about the auction and our services.
- To keep our systems secure and prevent fraud.
- To understand how the site is used and to measure our advertising.
- To meet our legal obligations and enforce our agreements.
If you are in the European Economic Area or the United Kingdom, we rely on these legal bases: taking steps toward, or performing, a contract with you (the NDA and the auction documents); our legitimate interests in running fair, secure auctions and improving our site; compliance with our legal obligations; and your consent where the law requires it.
Who we share it with
- Our service providers, who handle information for us under confidentiality obligations: website hosting, database and file storage (Vercel), email delivery (Resend), site analytics and error reporting (PostHog and Vercel Analytics), advertising measurement (Google), our auction software provider (Innovative Auctions Limited, only when needed to fix a problem with the auction platform), our bank (PNC Bank) for deposits and payments, verification providers, and our professional advisers.
- The seller of the assets in an auction. We do not tell the seller who you are, or whether you register or bid, except to arrange a management meeting you ask for, as needed to enforce the NDA, or after the auction as the auction rules allow (for example, so the winning bidder and the seller can close the sale). We may share data room activity with the seller without identifying you.
- Other bidders. We do not disclose one bidder's identity or bids to another bidder, except as the auction rules provide.
- Authorities and others, when the law requires it or when needed to protect our rights, our bidders or the public.
- A buyer of our business, if we sell or reorganize it, subject to this notice.
We do not sell personal information.
Cookies and analytics
We set a cookie to remember your answer to our cookie banner, and sign-in cookies on password-protected and administrator pages. We also use:
- PostHog, to see how the site is used and to report errors. It uses cookies and browser storage, and its requests go through our own domain.
- Vercel Analytics, for page-view statistics. It does not use cookies.
- The Google Ads tag, to measure whether our ads lead to contact requests. Google may set its own cookies.
You can block or delete cookies in your browser settings, and you can manage Google ad personalization in your Google account. Blocking cookies may stop some pages, such as password-protected ones, from working.
How long we keep it
We keep signed NDAs and NDA records for as long as the NDA's obligations last and any time needed to enforce them. We keep bidder verification, auction and payment records for as long as the law requires for record-keeping, tax and anti-money-laundering purposes. We keep other information only as long as we need it for the purposes above. Then we delete or anonymize it.
Security
We use encryption in transit, restrict access to the people and providers who need it, and log access to data rooms. No system is perfectly secure. We will never change our wire instructions by email: confirm any payment instructions with us by phone.
International transfers
We are based in the United States, and our providers mainly process information there. If you are outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those where you live.
Your choices and rights
Depending on where you live, you may have the right to access, correct or delete your information, to object to or restrict how we use it, to receive a copy of it, and to withdraw consent you have given. If you are in the European Economic Area or the United Kingdom, you can also complain to your data protection authority. California residents may have rights under California law.
To make a request, email info@applicantauction.com. We will confirm your identity before we act. We may need to keep some information, such as signed NDAs and records the law requires us to keep.
Children
Our site and auctions are for businesses and adults. We do not knowingly collect information from anyone under 18.
Changes to this notice
We will post any changes on this page and update the date at the top. If a change materially affects registered bidders, we will tell them directly.
